Terms of Service

The basic terms that apply to your use of the iOrderUP platform and website.

These Terms of Service ("Terms") govern your access to and use of the iOrderUP website and the iOrderUP AI phone assistant platform (together, the "Service"), provided by iOrderUP ("iOrderUP," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Description of the Service

iOrderUP provides AI-powered telephone answering services. The Service answers incoming phone calls on behalf of a business customer, responds to caller questions, takes orders and requests, and transfers calls to a human staff member when needed. The Service currently operates in English, Spanish, and Portuguese.

2. Who May Use the Service

The Service is intended for use by businesses, such as restaurants and food trucks, that engage iOrderUP to handle their incoming phone calls, and by the customers who call those businesses. You must be legally able to enter into a binding agreement to sign up as a business customer of iOrderUP.

3. Business Customer Responsibilities

If you are a business using iOrderUP to handle your calls, you agree to:

  • Provide accurate menu, pricing, hours, and policy information for the assistant to use;
  • Use the Service in compliance with applicable laws, including consumer protection and telecommunications laws;
  • Ensure you have the right to route your business phone line to the iOrderUP platform; and
  • Promptly review and act on orders and messages relayed by the assistant.

4. Acceptable Use

You agree not to use the Service to: violate any applicable law; transmit unlawful, abusive, or fraudulent content; attempt to interfere with or disrupt the Service or its underlying infrastructure; or attempt to gain unauthorized access to any part of the Service.

5. Service Availability

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. The Service may occasionally be unavailable for maintenance, technical issues, or circumstances outside our control, and calls may in some cases be transferred to voicemail or a backup process.

6. Intellectual Property

The iOrderUP name, website, platform, and related content are owned by iOrderUP and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use the iOrderUP name or branding except as expressly permitted.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. iOrderUP does not guarantee that the AI assistant's responses will always be complete, accurate, or free of error.

8. Limitation of Liability

To the fullest extent permitted by law, iOrderUP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, or data, arising out of or related to your use of the Service.

9. Changes to the Service or Terms

We may update these Terms from time to time to reflect changes in our Service or for legal or operational reasons. Changes take effect once posted on this page, and continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict of law principles.
